So what is the outcome of the Alliance? I think that any judgment that only increases uncertainty about the correct interpretation of a provision is, by definition, bad judgment. In the present case, the mixture of categories of objects and effects, in attempting to respond to a request for a preliminary ruling which simply does not contain the necessary legal and economic facts, has led to a judgment which merely hinders a quite clear dichotomy: first, market sharing, horizontal and vertical price cartels are prohibited in themselves, whatever consequences it may or may not have had. Secondly, agreements which have no subject-matter are covered by Article 101(1) only if they have an adverse effect on competition. Whatever we may think of the exact classification of certain types of agreements as restrictions in the category of object or effect (vertical resale pricing should be considered per/hardcore/object limitation?), it is useful to at least be aware of this classification and the underlying dichotomy.
